Mr. Hoffman's analysis is abso-FREAKING-lutely spot on. I cannot see where much of anything has changed in regards to RKBA. In other areas it may be that things have gotten worse. Her testimony would lead one to wonder if the whole concept of rights being endowed by Creator God is not about to be set aside. She would seem not to hold such views. If rights are not an endowment from God then they must have been bestowed upon us by the state. And what the state can bestow, the state can withdraw.
I wonder how long it will take them to get rid of the concept of governing by the consent of the governed? Honking big difference there. Read about it here http://americanvision.org/3130/consent-vs-compliance/
Kagan's a moonbat - so was Kennedy. Ergo this - in reality - changes nothing.
What blows me away is that someone who has not only never been a judge, but actually never even argued a case in front of one could become a SCOTUS justice!
OTOH, Dear Reader never held anything resembling a management (much less executive) position either.
Bottom line? Kagan's an incompetent, appointed by and incompetent, and approved by incompetents.

She replaced Justice Stevens who is, indeed, a moonbat. It would be difficult to surpass that old nut, based on his rambling and fever-induced dissents.
Justice Kennedy, despite the terrible connotations of that last name, is considered the swing vote.
Having known several big, fat, stupid collectivist dykes in my life, I don't have any illusions about Ka-gan. Anybody that gets more pussy than Frank Sinatra is probably going to be a problem. Hopefully, her and the "wise Latina"(haven't encountered one of them yet) will be rolling in the hay so much they won't be bothered by all that Court stuff. And Ginsberg can drink up any blood spilled.
Neither the Constitution, the Supreme Court, the Congress, the Senate, or the President, GIVE ME MY RIGHTS. None of them. I have MY RIGHTS BECAUSE I AM FREE, I will Live Free and Die Free. I am Free because I will Defend that Freedom against All that would Try to infringe or limit that which is not theirs to Legislate.
I am done negotiating for that which belongs to Me.
So... she was never a judge... and yet she becomes a member of the Supremes (no, I'm pretty sure she can't sing, either...), so does that mean I can be a Supreme Court judge, too?
Bill III (Obviously drinking heavily at this point... and why not?)
Kagan's (and Sotomayor's) nomination and confirmation is just another example of why we aren't going to be able to vote our way out of this shitstorm. I feel less and less significant every day. If people don't realize soon that elections have consequences. it will be too late. It may, in all reality, already be.
I think "Dear Reader" is a blessing of sorts. I hope POTUS and Crew ramp it up even faster. It makes no difference to me what this or the previous Regime did or does, the faster the better. Let's get it done so my Children and Grandchildren and live it good.

Let's just hope Kagan slips in the next SCOTUS photo op and lands on Sotomayor and Ginsburg.
As for not being a judge well Sotomayor was and had a huge overturn rate and look where that got us.
I can't believe the repups caved so bad on these last two nominations. Or actually I can.
