Government does not 'give' rights as the only tool it has is legislation with which it can only attempt to extinguish or regulate pre-existing rights.
Anything not prohibited is allowed.
The Bill of Rights attached to the Constitution merely records rights which existed before it was written and records that specific rights are unalienable. It does not cover all rights as some exist that are not enumerated and they too are preserved.
The BOR and Constitution do not protect rights - it is our duty to protect the Constitution from Tyrants both foreign and domestic.
