BLACK THURSDAY

Regardless of what happens with the Holder contempt vote, today will likely be remembered by freedom-loving people as Black Thursday. My response to a reporter a few moments ago: "You may call tyranny a mandate or you may call it a tax, but it still is tyranny and invites the same response."
"Hey, what's the address o' the Supreme Court? I wanna write 'em a nasty letter."
LATER: The other day I did an interview which will appear, I am told, on Monday. Here is a relevant portion of that which deals with the decision today.
Question: You said in an interview with the Washington Post that a handful of Americans “are armed and are capable of making such resistance possible and perhaps even initiating a civil war.” Would you support a civil war over health care law?
"Initiating a civil war" is a misquote. All of my work has been focused on preventing a civil war by making the clueless understand that one is possible. Their Weltanschauungs prevent it. I'm trying to get them to understand that we are in fact two countries now. We share a common language (most of us) and border, but we disagree on the critical question that the Founders answered with defensive violence against King George's violence -- shall the people serve the government of the government serve the people? Does it matter if we agree on traffic laws or the rules by which our kids play soccer if we disagree on something so fundamental? The health care law carries with its meeching platitudinous promises the hard steel fist of government violence at the center. If we refuse to obey, we will be fined. If we refuse to pay the fine, we will in time be jailed. If we refuse to report meekly to jail, we will be sent for by armed men. And if we refuse their violent invitation at the doorsteps of our own homes we will be killed -- unless we kill them first. It is Nancy Pelosi who first plunked the threat of violence on the table like Goering reaching for his revolver. How should principled, free people react to such threats? I am on record as advocating the right of defensive violence against a tyrannical regime. The Founders would agree. If someone on the street threatens to break into my house and steal my property or kill me, and I tell them, "If you do this, you will be killed," am I the violent one? Or is it merely good manners to warn the miscreant of the probable outcome?
I was once asked by a gun prohibitionist my thoughts on his desire for my disarmament. I began to explain as best I could and he cut me off with an impatient, "Give me the short answer." "Okay," I said after pausing briefly, "If you try to take our firearms we will kill you." He left quickly, muttering oaths about my sanity. Yet you will get the same answer from that other half of the country that such people make no attempt to understand, only deride and name-call. Such ignorance can get a whole lot of people killed. That is the point I'm trying to get across. If the Constitution as crafted by the Founders and the rule of law no longer applies, that is, if we now have the law of the jungle, then my half of the country is far better prepared to live and thrive in that jungle others force into than they are. Another formulation: If the rule of law no longer protects us from government tyranny, it no longer protects that tyranny and its acolytes from us. It is a two-way street and I hope desperately that Nancy Pelosi and her ilk understand that before it is too late.
Question: What are your thoughts about how the Supreme Court will rule on health care Thursday? What do you see as the potential implications of its decision?
See above. If the individual mandate is upheld, me and a few million of my friends will not comply and we will make ourselves so obnoxious in our refusal that sooner or later some government agent is going to try to kill us. Because the one thing a tyrant cannot tolerate is the example of someone being unafraid and saying "No." It's a bad example for the rest of the sheep and might encourage noncompliance. When that happens, you have only to read history to predict the outcome. To believe anything else is to whistle past the graveyard of history.
This public service announcement brought to you by Sipsey Street Irregulars.

To say I'm pissed at the moment is an understatement. It is simply unbelievable we have a SCOTUS who believes it is constitutional for government to tax citizens simply because they breathe. With a minimum tax of $695 per person Barak "Not One Dime of Tax Increase" Obama gave us the largest tax increase in American history while yet still having the audacity to insist it's not really a tax at all.

This government is illegitimate. The people have been betrayed by absolutely everyone. And now by the court that is supposed to represent their interests ultimately, in the founding documents and the freedoms that were bequeathed to us by them.

Anyone who disagrees with you is now your sworn enemy, an enemy of freedom and self determination, an enemy of your constitutional rights.

Remember, THEIR court did this to you because it certainly doesn't in any way represent you, nor the concepts and principles this country was founded upon. The existing system and politicians made this possible and willed it to be so. ALL of them, ALL of them are now your enemies, so declared by their own hand.

DO NOT FORGET THE MEDIA"S ROLL HERE BECAUSE THIS COULD NEVER HAVE HAPPENED WITHOUT THEIR DIRECT ASSISTANCE.

These people fully believe that they can do what they want and that there will be no personal consequences to them, which is why they are doing these things.

Traitors, all of them. It's past time to start using that word because it is the only one that accurately fits. Remember their names and remember their faces.

The litmus test is the constitution and bill of rights and we now find that they have many hidden enemies as well, even within the republican party. Even within the "independent judiciary." I guess we always knew it deep down but now there is no doubt and no hope of help from any quarter but our own.

Also remember that you are being monitored by their servants in everything you attempt to do. Say that to yourself again and again because I assure you, they are there on the other side of your screen and maybe down the road or across the street. It's that kind of world for us now, by us I mean the average citizen.

Their systems and servants aren't there to monitor anyone but you and people like you. Also, without your permission, in direct contravention of the constitution and bill of rights, paid for by you and your children.

I love this country dearly but I owe these fuckers nothing. Thieves and traitors all.

There will be no political solution to this situation so get used to the idea right out of the gate. They just removed those options from the table completely and forever more. The constitution and bill of rights mean absolutely nothing at all, anymore, forever more.

According to them.

Now who's willing to bet AGAINST Dear leader come November?

This is s brutal loss but it is not decisive.

The Republican's putative nominee for President has promised to dismantle Obamacare.

Numerous states have amended their constitution so as to prevent the implementation of individual medical mandates.

The operational costs of enforcing this law are steep and even if the effort is successful, the law as written will assuredly bankrupt the US Treasury.

Polls reveal widespread dissatisfaction with Obamacare. Consequently, the USSC ruling further delegitimizes the regime.

This is like Gandalf's defeat by the Balrog; loss as prelude to a greater victory.

Anyone else know how the penalty/tax/fine works?

Does it come straight out of your check like with Social Security? That's my guess. They'll force you to quit your job rather than pay. We'll see who's willing to put their money where their mouth is if that's the case. I'm fine with not paying AND dropping my health insurance from work....if they were actually going to send me a bill for it....but that's not how it works.

They're going to take it out of your check before you ever see it...and how are you going to protest that one?

Help me out here....

I just... can't believe it. I actually had it in my head that the same SC that ruled in favor of Heller and McDonald would easily vote in favor of the 10th Amendment... I think my anger in this matter is more directed at myself for being a fool and hoping the SC would actually uphold the Constitution.

I am beginning to feel the same fear I had in Iraq when we were headed directly into a very active firefight, combat is inevitable yet despite our fear we fought as one and we fought hard.

I am scared. Yet, more importantly, I am Resolved.

Anonymous said...

Sean, here is my understanding of it-- The "tax" is being handled by the IRS and will be treated as such. Exact details forthcoming, but imagine your 1040 asking a new question: "Do you have health insurance? If so, please attach the employer issued verification form. Otherwise, add line X to your total tax liability." If you owe the "tax" and have a refund due, then your refund will be reduced accordingly. In that case, there is no way you can choose to not pay the "tax".

If you don't have a refund due and owe the tax then refusing to pay the health care "tax" will essentially be like not paying your income tax. First letters will be sent to you by the IRS, penalties applied, threats made, etc. When armed officers finally come for you the neighbors and media will be told you are a tax evader, so look for them to applaud the agents who knock down your door.

Yes, Sean that is how they will do it. They'll never do it outright like sending a sheriff after you or a tax collector, whatever. That wouldn't work because many if not most would refuse. Also they would never give us a chance to see the sunrise between their eyeballs.

They'll strong arm people via your paychecks and taxes. Why else do you think they forced as many as possible to be paid by a company paycheck? That payroll deduction will be taken before you have a chance to get your hands on your own money and say "Fuck you, I'm not buying." You can quit but then they'll tax it out of you. If you refuse they'll take your home and property...not outright but on paper like cowards. Then when you refuse to vacate or pay they'll come for you. That won't go to well. But unless there is enough people doing it they'l knock everyone off a little at a time and hand over YOUR property to some piece of welfare shit. And he won't be white either. Just to make that PERFECTLY FUCKING CLEAR.

If you are the company owner and you refuse to take those deductions from your employees they'll just do the same to your business and probably make you look like the bad guy to your employees who might end up out of work. Again...a stunt like that could get real ugly for whoever tries to take you away or take your business IF it is done physically. They'll probably emply some of all that .40 if that happens.

Some are in a position to just quit their jobs, sell their homes and give them all the finger. Money is not all it's cracked up to be. But most have families and so will likely not do it.

I don't think they EVER intended to give us a chance to get at them. We aren't untouchable. But neither are they. Nobody is unreachable. Nobody.

A possible scenario:

"Americans who do not buy health insurance will not be found guilty of a
crime; but if they are due a tax refund, the government will withhold
money from that refund. In 2014 the penalty will be the greater of $95,
or 1 percent of income, as long as the amount is not greater than the
cost of a basic health insurance plan. In 2016 the penalty increases to
as much as $695 per adult, or up to 2.5 percent of household income." http://www.dcbar.org/for_lawyers/resources/publications/washington_lawyer/january_2011/obamacare.cfm

It is withheld from your income tax refund.

BHO could expand the penalty to include tax leans on your property and garnishing of your wages. This would be done by Executive Order.

If you quit your job or go "off the books" your house would still remain subject to a sheriff's sale.

The question that must be asked of all concerned is how committed are you to the cause of restoring liberty if it can be?
We as a nation have asked generation after generation of our young to put their lives on the line for freedom. And each time they have, and usually for someone elses freedom.
Now we lay witness to chip after chip being taken from the rock of freedom and we sit idily by. Sure we vote, sure we voice our concerns, sure we talk, but it hasnt made much of an impact has it?
They just chip away, emboldened by every good size chip they take away that makes their version of utopia more of a reality.
Some day our children will ask us what the US used to be like. Will you hang your head in shame?
Are we too comfortable, content, or just lazy to say "no more", to put our lives on the line, to put it all out there, everything at stake, realizing that we may never come home... Is it worth it to you?
That is the question.

Chief Justice Roberts Is A Genius

Posted on June 28, 2012 by I.M. Citizen

Before you look to do harm to Chief Justice Roberts or his family, it’s important that you think carefully about the meaning – the true nature — of his ruling on Obama-care. The Left will shout that they won, that Obama-care was upheld and all the rest. Let them.

It will be a short-lived celebration.

Here’s what really occurred — payback. Yes, payback for Obama’s numerous, ill-advised and childish insults directed toward SCOTUS.

Chief Justice Roberts actually ruled the mandate, relative to the commerce clause, was unconstitutional. That’s how the Democrats got Obama-care going in the first place. This is critical. His ruling means Congress can’t compel American citizens to purchase anything. Ever. The notion is now officially and forever, unconstitutional. As it should be.

Next, he stated that, because Congress doesn’t have the ability to mandate, it must, to fund Obama-care, rely on its power to tax. Therefore, the mechanism that funds Obama-care is a tax. This is also critical. Recall back during the initial Obama-care battles, the Democrats called it a penalty, Republicans called it a tax. Democrats consistently soft sold it as a penalty. It went to vote as a penalty. Obama declared endlessly, that it was not a tax, it was a penalty. But when the Democrats argued in front of the Supreme Court, they said ‘hey, a penalty or a tax, either way’. So, Roberts gave them a tax. It is now the official law of the land — beyond word-play and silly shenanigans. Obama-care is funded by tax dollars. Democrats now must defend a tax increase to justify the Obama-care law.

Finally, he struck down as unconstitutional, the Obama-care idea that the federal government can bully states into complying by yanking their existing medicaid funding. Liberals, through Obama-care, basically said to the states — ‘comply with Obama-care or we will stop existing funding.’ Roberts ruled that is a no-no. If a state takes the money, fine, the Feds can tell the state how to run a program, but if the state refuses money, the federal government can’t penalize the state by yanking other funding. Therefore, a state can decline to participate in Obama-care without penalty. This is obviously a serious problem. Are we going to have 10, 12, 25 states not participating in “national” health-care? Suddenly, it’s not national, is it?

Ultimately, Roberts supported states rights by limiting the federal government’s coercive abilities. He ruled that the government can not force the people to purchase products or services under the commerce clause and he forced liberals to have to come clean and admit that Obama-care is funded by tax increases.

Although he didn’t guarantee Romney a win, he certainly did more than his part and should be applauded.

And he did this without creating a civil war or having bricks thrown through his windshield. Oh, and he’ll be home in time for dinner.

Brilliant.

I'm starting to agree in part with "The Trainer's" assessment of Roberts decision.

Below are two rather odd quotes from Chief Justice Roberts on the Supreme Court’s responsibility in handling the health care law.

“We do not consider whether the Act embodies sound policies. That judgment is entrusted to the Nation’s elected leaders.”

“Members of this Court are vested with the authority to interpret the law; we possess neither the expertise nor the prerogative to make policy judgments. Those decisions are entrusted to our Nation’s elected leaders, who can be thrown out of office if the people disagree with them. It is not our job to protect the people from the consequences of their political choices.”

Where "the Trainer" and I part ways is that I think this WILL cause a civil war. Essentially, the law, written as a "penalty" clause had no real teeth and didn't apply any criminal standard. By Justice Roberts making it a "tax".....he makes it a criminal act to refuse to pay (tax evasion).......and now the law has teeth. This is the "consequence" this activist judge has laid at our feet as WE, the people, elected the leaders that ignored the 70+% of us who contacted our elected leaders during the helath care debate to tell them we didn't want this abomination passed.

I'm not sure he was trying to drive a bigger wedge between our countrymen and start a civil war or if he was just setting up a big states rights argument/court case, while trying to help get Romney elected....but I fear the result will be armed conflict.

JMO,
Sean

You all miss the fact that the ACA ruling will do far less damage than a couple of other 5-4 votes from SCOTUS.

2) Citizens United, allowing corporations to simply buy elections

With all your seditious talk, with all of your talk about inciting violence, with all of your talk about 'taking your country back', you prove over and over again that NONE of you are actual patriots, and most of you aren't even worthy of being American citizens. Failure to do so subject to a $5000 tax penalty. Then we all grab a cold one, pop some corn, and set back to watch their tiny little heads explode.

I agree 100% with almost all of you, I have my own little point to toss out there for your preview!
Socialism FAILS, everywhere it has ever been tried, we all know that, right? So, why, rather than convert us to red flag waving socialists, actually socialism is the beginning of communism, but....instead of us becomeng them, and failing, why is it so difficult for them to embrace democratic republicanism, capitalism, instead? That's always bothered me, for me it means that MOST of the world would rather be led, force fed, nuetered, and followers, than be shining examples to the world, which leads to me to believe most folks are simplt too weak and wussinfied to secure and defend their own freedoms and accept the life of the salve rather than the high demands of freedom and liberty!

How sad is that?
