As a former Marine, Law Enforcement officer and biker, this story is so very sad. I cannot understand why they shot him. The use of the Taser is justified in some instances but I fail to see why he needed to be Tasered while throwing up in the flower bed. How dangerous was he as he laied in the flower bed? Shot him 3 times in the chest? Why? Why was this man, an "alleged gang member" or not treated like an animal? News Flash America, the cops are supposed to be "Public Servants" which means they serve us. When we as a people begin to fear our own law enforcement we're in trouble.

As a former Marine, law enforcement officer and Harley rider I am saddened by this story. To be tazed 3 times and then shot like an animal is inexcusable. With that many officers around him why did they have to shoot him and not just use "the swarm" tecnique?It is no wonder the trust for law enforcement has become more fear than respect. When citizens begin fearing "thier" law enforcement officials this country is in trouble.

Some good comments. But come on, do we really think this experience is rare? It actually happens every day.. but there is rarely any media attention, especially when it's a minority.

I'm pretty surprised the cops didn't shoot the kids and his wife and the witnesses too. Looks like this event wasn't so bad compared to most.

The cop got off "innocent" according to Vice Gangleader President Joe Biden's son Beau Biden. One big happy Crime Family.

Haha, why even attempt to go after the cops? It should be known in America, as it is in 3rd world countries that America has been for decades now; that the only true terrorists are the ones funded and empowered by The Almighty State.

You're more likely to be arrested for a non-violent crime or assulted by police than robbed working in a convenience store at 3am.

I have read every story on the net and this one has left me sick to my stomach. I also am concerned that alot of talk about investigation is mentioned but no talk of the FBI. This must be taken to the Federal level. Also Federal lawsuits have no $$ limits and a three year statute. Money is a form of punishment. My son was tasered by these same sadistic type people and I contacted the FBI the next day. After a 14 Month investigation that led to mulitple coruption findings, two Deputies were arrested 07-31-08 and are facing three charges that carry up to a 30 year prison sentence and a $500,000 fine. Beware that all Policeman are always right. The bad ones number high and the good ones will not "RAT" on them so that makes it dangerous for innocent people everywhere. One of the charges for the two animals that tasered my son... Conspiracy to avoid Federal prosecution, a 5 year sentence. Let's stop this madness by putting them in jail and depleating the funds from the towns who hire these criminals.

The bill failed. Still waiting on the DVD of him OC Spraying another victim and still waiting a decision from the Court on my Right to Know litigation, you can listen to it here and video is coming.

Thank you for posting this. I am using the Derek Hale incident to warn others of their dramatic loss of rights to person and property, and found your detailed post. I will send something to his next-of-kin. A comment about someone else's comment regarding dangers to Elaine Hale and her children: one way to reduce the risk of (further) attack is to make sure that the government agencies involved know that someone cares about the potential victim...a "heartbeat protocol" whereby everyone in the group keeps track of everyone else, and goes after anyone who attacks someone in the group. It's not much but it's better than trying to defend yourself as an isolated individual against an out-of-control state.

These officers need some sort of accountability. It is my sincere hope that at some point we have police officers being forced to pay a type of insurance payment as we have our medical professionals in the form of malpractice.
#1. If they make a mistake, the citizens of the jurisdiction are not forced to pay for the mistakes of the offender.
#2. If an officer has too many infractions, his rates could be charged in accordance with his offenses.
#3. If an officer moves from one jurisdiction to another, his past records cannot be lost or misplaced.

I do hope that Derek's surviving family members and friends (especially those present at the scene of the murder) are exercising extreme caution and taking extra measures to guarantee their safety. Because this high-profile lawsuit will very likely result in some ugly consequences for agents of the State, it is no paranoid exaggeration to believe that law enforcement elements in Delaware and Virginia will go out of their way to make life for Elaine Hale and her children as uncomfortable as possible. If cops can behave as violently and recklessly as they did at the time of Derek Hale's murder when they had the upper hand in the situation, it stands to reason that they would behave like cornered wild animals when threatened with accountability and/or punishment.
