I want to take a moment to thank the good people of Berkshire County and around the globe who have held me in their prayers and others who have held me in their arms as I have been persecuted by the police and the prosecutor. I have to believe that the pain I have suffered these past seven months will someday be healed by the good that will come as a result.
I want to share some things I have learned as my husband and I have spent hours of our life now observing what happens in the court room and hallways of the North Adams Court House. The only way this evil will stop is to bring it out to the light of day. Many have come forward due to this situation and stated, "Isn't it terrible how we are losing out rights." What people seem to have lost sight of is that you can't lose your rights, you can only give them away. Our rights and freedoms are not bestowed upon us by the government. They are bestowed upon us by God.
If the police have charged you falsely and there is no evidence to convict you the case should be dismissed, but what really happens is that those who call themselves attorneys go out in the hallway and browbeat you to "cop a plea." They make it sound like you aren't pleading guilty and that after a year it will all go away. This in fact is not true, as anyone of average intelligence can tell if one listens to the judges instructions. What you are really doing is pleading guilty and giving up all your rights. They also don't tell you that the judge does not have to accept it as it was explained. If the judge chooses to he/she can send you to jail. I sit in amazement as I watch the police and DA, who are supposed to be in the business of getting people to admit to wrong-doing and take their punishment, are themselves incapable of doing that.
The only players in the court room who seem to know that we have a Bill of Rights are the judges and my attorney. I guess the other attorneys missed class the day they taught about the Constitution, which probably was taught on the same day as "THE RULES OF THE ROAD" class that seems to have only been attended by the trucker's laywer Mr. O'Rouke.
They also don't tell you that if you are charged again in that twelve months your plea automatically reverts to guilty. If the police deceide to extract their special breed of revenge on you they will and it will go something like this. Routine traffic stop, the usual illegal search of your car and "TA-DA" some controlled substance that mysteriously fell out of the sky will be found. Mike Chalifoux, a Vietnam Vet and hero to our country, who himself was falsely charged and put in chains, put it so well when describing that type of mentality. He said, "Linda, what kind of a person chooses a career in which you spend your whole life telling on other people?"
